ACCC appeals Magnamail misleading promotion case dismissal

Mail-order retailer Magnamail faces another defence of its case over allegations of misleading or deceptive conduct in advertising after the Australian Competition and Consumer Commission (ACCC) said it would appeal a Federal Court decision dismissing the suit.

The regulator had alleged that Magnamail made misleading representations in its promotional campaigns, including those relating to prize offers to consumers.

However, the Federal Court dismissed the ACCC’s proceedings, prompting the consumer watchdog to lodge an appeal against the decision.

The appeal will see the regulator seek to overturn the dismissal and continue its case against the retailer.

The ACCC’s action forms part of its broader enforcement of Australian Consumer Law, particularly around marketing and promotional practices that may create misleading impressions for consumers.

The matter will now proceed through the appeals process, and the outcome could provide further guidance for businesses using prize promotions and direct marketing campaigns.
